Xarelto Lawsuit Cases See Bellwether Trial Updates

The trials, which are being overseen by U.S. District Judge Eldon Fallon, have been the topic of a recent order. The order details that bellwether trial cases will be selected from a group of 40 cases in January of 2016. The selections made will be based on which cases seem most prepared to go to trial.

According to further details, the first 2 of 4 bellwether trials are set to be heard in the United States District Court for the Eastern District of Louisiana on February 6th and March 13th, 2017. The third trial is set to be heard in Mississippi on April 24th, 2017, while the final bellwether trial will take place in Texas on May 30th, 2017.

Federally, Xarelto lawsuits currently make up over 1,700 cases. Complaints within the cases are filed against defendants Janssen Pharmaceuticals (a subdivision of Johnson & Johnson), and Bayer AG. They have been consolidated to form multidistrict litigation number 2592, and similarly contain allegations that anticoagulant Xarelto caused uncontrollable bleeding events and even death. Many have termed Xarelto the most dangerous blood thinner currently on the market, due to the fact that it was released for sale without a corresponding antidote.

The fact that Xarelto has no antidote means that if someone taking it is injured and bleeds, physicians cannot reverse Xarelto’s effects and make that person’s blood clot. In these situations, doctors must resort to life-saving measures such as major blood transfusions to keep the individual alive. Traditional blood thinners like warfarin, however, do not create this problem. When someone using a traditional blood thinner bleeds, physicians can give them a vitamin K treatment. Unlike Xarelto, these blood thinners respond to vitamin K, which counters their effects and makes the person’s blood clot.

These dangers have played a large role in the fact that many people have filed suit against the drug. At this time, Xarelto is the subject of over 2,000 lawsuits: more than 500 which have become part of a mass tort group in Philadelphia, PA, and over 1,700 federally filed cases. It is fully anticipated that as these cases await bellwether trials, others will continue to appear.
